Article 1 : Intellectual and/or industrial property

Article 2 : Acceptance of the conditions
The Customer agrees, at time of order, that he/she is aware of the particular conditions of sale specified on the site as well as the conditions in this section which together constitute the general conditions in respect of online sales of Tarbais Haricot Cooperative products. The said general conditions of sale take precedence over any other conditions in any other document unless express prior modification has been agreed in writing by the Tarbais Haricot Cooperative and they exclude all other conditions of sale, in particular those relating to store and/or catalogue sales. Therefore, any order placed by the Customer implies full acceptance of these general conditions, which apply only to a contract established in this way. Contractual information will be confirmed and repeated at the latest when the goods are delivered. In the absence of any evidence to the contrary, the data recorded by the Tarbais Haricot Cooperative will act as proof of the whole series of transactions and orders placed by the Customer.
Article 3 : Product description
Products are described by the text, which gives information about the basic characteristics of each individual product. The photographs used to illustrate products are excluded from the terms and conditions of contract. The Tarbais Haricot Cooperative in no way accepts responsibility for any errors which may occur therein.
Article 4 : Content and acceptance of orders
All orders placed with the Tarbais Haricot Cooperative are intended for Customers’ personal use. Customers therefore undertake to refrain from any industrial and/or commercial use and/or resale, in whole or in part, of our products. The Customer expressly agrees that he/she has had the opportunity to check the details of the order placed and the total price and to correct any errors which may have occurred, before confirming the order. Information submitted by the Customer is binding in respect of the following : in the case of errors in the quantity or description of the product ordered, or delivery information supplied, the Tarbais Haricot Cooperative cannot be held responsible for failure to deliver the product. The Tarbais Haricot Cooperative will not consider the order as accepted until confirmation of order has been sent to the e-mail address supplied by the Customer and such confirmation will not be sent until full payment for the order has been received in accordance with the conditions in article 9 below
Article 5 : Delivery period, conditions and charges
Delivery charges vary according to the type of delivery selected and the final destination. For metropolitan France, the Customer can choose between “Colissimo” and “Colissimo suivi France”. Delivery charges are calculated automatically in relation to Post Office tariffs and the weight of the parcel. All taxes are included for each order to a single delivery address. For deliveries outside metropolitan France and for the DOM/TOM areas, transport will be by means of “Colissimo international”. Delivery Period : The Tarbais Haricot Co-operative will make every effort to deliver to the Customer between a minimum of ten (10) working days from receipt of payment(via PayPal, bank transfer or cheque) and a maximum of 30 days from the date of confirmation of your order. This period is purely an indication. If we are unable to deliver because a product is not available, the Tarbais Haricot Cooperative will inform the Customer and will arrange for reimbursement within a maximum of 30 day following receipt of payment for the product(s) in question. Delivery Conditions : Responsibility for delivery and associated risks are considered as transferred at the date of despatch from the promises of the Tarbais Haricot Cooperative. Goods will be despatched to the address supplied by the Customer on the order. The Customer agrees to take delivery of the goods ordered. If there is no one to take delivery, the carrier will leave a note at the delivery address supplied by the Customer inviting him/her to contact the carrier in order to arrange a new delivery date or to collect the goods from the carrier’s premises.
Article 6 : Transport — Condition of Goods
Received Goods are sent at the risk and expense of the Customer for whom the Tarbais Haricot Cooperative organises transport. Therefore, it is the Customer’s responsibility to check the condition of the parcel(s) and ensure that the products therein correspond to his/her order as soon as they arrive. The Tarbais Haricot Cooperative cannot be held responsible for any deterioration in the products which may occur in transit and/or which may be caused by the Customer’s late/non-collection of the said products from the carrier. Any complaint must be made to the carrier and to the Tarbais Haricot Cooperative by registered mail with advice of delivery at the time the goods are received, or at the latest within three working days of receipt.
Article 7 : Guarantee of Conformity
In accordance with the conformity guarantee required by law, products and their related packaging which appear faulty, spoiled or damaged will be replaced or made good. If such circumstances arise, the Customer should write to the Tarbais Haricot Cooperative, detailing the faults found in the products and/or their packaging. The cost of returning the goods and the replacement delivery charge will be reimbursed on the basis of the amount first invoiced and on production of relevant proof of the expense incurred. In any case, the Customer has the benefit of the provisions of the legal conformity guarantee in respect of latent defects. The provisions specified in this article do not prevent you from exercising your right of cancellation under article 11.
Article 8 : Price
The prices charged for the products will be those shown on the site at the time the Customer places the order. Prices are expressed in Euros, inclusive of all taxes but exclusive of delivery charges. Delivery charges shown on the order confirmation and on the invoice are fully inclusive of tax.
Article 9 : Payment Methods
Orders placed online are payable immediately, on the conditions mentioned below and without any discount. Customers can pay : online via the PayPal secure payment system, by credit card ( Visa, Eurocard, Mastercard, etc.) at time of order, by bank transfer or by cheque drawn on a French bank. Online orders will be processed once the Tarbais Haricot Cooperative has received the Customer’s cheque for the total cost of the order, including any taxes. Orders paid for by other means (bank transfer or cheque) will be processed once the total amount has been credited to the Tarbais Haricot Cooperative account. Cheque payments must be drawn on a bank domiciled in Metropolitan France. Cheques are cashed on receipt and should be sent to the Tarbais Haricot Cooperative together with a copy of the order form.
Article 10 : Cancellation of Order
By law, the Customer has the right to cancel his/her order and return the goods to the Tarbais Haricot Cooperative within seven (7) clear days from delivery, on condition that they are returned in their original packaging and in perfect condition. Returned goods should be sent to our Customer Service Department at the following address : Cooperative du Tarbais Haricot - zone de Bastillac - 65000 TARBES. The Customer is responsible for the cost of returning the goods. The Tarbais Haricot Cooperative undertakes to reimburse the Customer with the price paid for the goods within thirty (30) days following the date on which the Customer has exercised his/her right of cancellation.
Article 11 : Responsibility
We have taken every care to ensure that our products correspond to the description on the website at the date of order and that they conform to current French legal requirements. It is therefore the Customer’s responsibility to ensure, on his/her sole responsibility, that the products can be delivered and consumed in the final country of destination. The Customer must adhere to the “Use By” dates shown on the products. In addition, the Tarbais Haricot Cooperative wishes to draw the Customer’s attention to the fact that he/she must not consume or allow anyone else to consume the products after the expiry of the dates indicated on the packaging, nor if it appears that the product has deteriorated. The Tarbais Haricot Cooperative cannot be held responsible for any contractual failure which may be caused by force majeure or by circumstances beyond its control such as, in particular : war, riot, strikes, fire, transport problems, storm, and/or unforeseen and unavoidable action/failure on the part of a third party to the contract and/or by the Customer.

Article 14 : Legal Jurisdiction – Settlement of Disputes
The original of this contract has been drawn up in French. This contract is subject to French law. In case of any dispute, jurisdiction will be restricted to the French courts.
